Advice on Buying Property in France

Whether you intend to buy for investment or are simply looking for the ideal home, there has never been a better time to buy in France. Especially in our recommended areas of Haute-Savoie & Savoie ( Alpine and Lakes Properties ), and Provence/Cote d'Azur.

These areas are considered perfect places to holiday but also excellent for capital appreciation.

It is generally not difficult to obtain a mortgage to buy your property in France. Our mortgage advisor will assist you throughout the borrowing process.

The first thing you will notice in France is how strict the law is relating to a property purchase. This is done purely to protect you as a consumer. However, our team will support you through this.

Property prices are always in Euro and all property contracts must be undertaken in the French language. You will need to appoint a solicitor (Notaire) in France and they will act on your behalf. You may also instruct a solicitor in your local country that specialises in French property purchases. This will help with the translation of contracts. Do ask us for further information if required.

Once the sale price has been agreed, an agreement called the 'Compromis de Vente' has to be signed. At this point your personal details are required in order for the French Notaire (Solicitor) to prepare the contract. This contract which will also be signed by the vendor.

At this point a deposit, usually 5%, is required. This deposit is payable to the Notaire's account, either by euro cheque or a Bank transfer. According to French law you have seven days to cancel the contract without giving reason and without losing your deposit. This seven day period will begin from the day you and the vendor sign the contract, (the date of the last signature will apply). The contract will always include the clause or condition for the mortgage approval, should you need one. In the event that your application for the mortgage is not approved, the sale is cancelled and your deposit of 5% will be returned to you without any penalties.

Mortgage approval will normally take 4 to 6 weeks.

You will then sign the Final Acte (Completion), normally 2-3months after the signature of the Compromis. This final contract can be signed at the Notaire's office or by proxy. It is at this point that the outstanding sum is transferred to the Notaire's account.

Legal Costs

It is the legal duty of the "Notaire" (Solicitor) to ensure a legal transfer of the property. The Notaire will also collect any stamp duty and other taxes due to the French Government. It is therefore perfectly acceptable for the same "Notaire" to work for both parties. However, you also have the right to appoint a second Notaire in France if you wish to do so.

The Legal fees and stamp duty amount to: Between 1.5% and 2.5% for new properties and between 6% and 7% for re-sold properties.
